Your bags are packed. You’re ready to go. Then comes the dreaded tannoy announcement…

Last year it was reported that Belfast International Airport was second only to Gatwick when it came to flight delays. With this in mind, it may be useful to know your rights before you head to the departure lounge.

Under EU Law, any passenger who is delayed by at least two hours is entitled to receive a written notice from their airline explaining the rights to compensation and assistance as well as providing details of the national authority with responsibility for passengers rights.

Passengers may be entitled to be compensation of between €250 and €600, depending on the length of the flight concerned. 

There is a defence of ‘extraordinary circumstances’, whereby an airline is not obliged to pay out.  The European Court of Justice (CJEU) considered this provision in the context of a technical problem with an aircraft in concluding that this was not ‘extraordinary’.  That said, some technical issues may well fall within this defence such as acts of terrorism.  

Despite their legal obligations, some airlines seem to try to make it as difficult as possible for passengers to receive the compensation to which they are entitled for flight delays.
